Copyright & DMCA
Sand Media hosts material uploaded by its users. If you own copyright in something posted here, this page is how you get it removed.
Report an infringement
Send a notice to copyright@sandmedia.cc. To be effective under 17 U.S.C. §512(c)(3), a notice must include all of the following:
- Identification of the copyrighted work you say has been infringed.
- Identification of the material you want removed, with enough detail for us to find it — a direct link to the post, page or file.
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.
- Your physical or electronic signature.
An incomplete notice may not start the clock. If something is missing we will say what it is rather than ignore it.
Designated agent
Notices of claimed infringement go to our designated agent:
Agent registration in progress. Until it completes, send notices to copyright@sandmedia.cc and we will act on them under the procedure on this page.
This agent is registered with the United States Copyright Office directory. Please use the address above for copyright notices only — other mail sent there will be slower to answer than support.
What we do with a notice
- We remove or disable access to the material promptly, usually within two business days of a complete notice.
- We tell the person who posted it what was removed and why, and we send them a copy of the notice.
- We record the notice against that account for the repeat-infringer policy below.
- Where the material was part of a paid campaign, removal may also end that submission’s earnings. That is a consequence of the removal, not a penalty we add.
Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the same address. It must include your name, address and telephone number, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification, your consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any district in which we may be found), and your signature.
If we receive a valid counter-notice we forward it to the person who sent the original notice. Unless they tell us they have filed a court action, we may restore the material in 10 to 14 business days.
Repeat infringers
We terminate accounts of repeat infringers. In practice: a first complete notice is a warning on the account, a second removes the account’s pages from paid campaigns, and a third ends the account. Unpaid earnings already confirmed by an advertiser are still paid out; estimates on removed videos are not.
A notice withdrawn by the sender, or one answered by a valid counter-notice that is not followed by a court action, does not count toward this.
If you post here
Upload only material you own or are licensed to use. For clipping work that means footage the campaign has given you, or material the advertiser has confirmed you may cut. Music, stock footage and another creator’s edit are not yours to post because they are available to download, and “it was on the internet” is not a licence.
Knowingly sending a false notice, or a false counter-notice, carries liability for damages under §512(f). This goes both ways.
